Terms of Use (EULA)

1. Introduction

These Terms of Use (“Terms”) form a legally binding agreement between you and FYN Labs LLC (“FYN”, “we”, “us”) governing your access to and use of our mobile applications, websites, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

3. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us promptly of any unauthorized use or security breach.

4. License and permitted use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

5. Prohibited conduct

• Use the Service in a way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to the Service or related systems.
• Interfere with, disrupt, or degrade the integrity or performance of the Service.
• Reverse engineer, decompile, or attempt to derive source code except where permitted by law.
• Use the Service to provide medical advice, diagnosis, or treatment.

6. Health & wellness disclaimer (no medical advice)

The Service is provided for informational and wellness/performance purposes only. We are not a medical provider and do not provide medical advice, diagnosis, or treatment.

Any insights, projections, simulations, recommendations, or content are not intended to replace professional medical advice. Always seek the advice of a qualified healthcare professional regarding any health-related questions.

If you think you may have a medical emergency, call emergency services immediately.

7. Data sources, accuracy, and simulations

The Service may use data you provide and/or data from connected sources (e.g., wearables, Apple Health, labs). Data can be incomplete, inaccurate, delayed, or misinterpreted.

Simulations and projections are models, not reality. They may be wrong and must not be relied upon as the sole basis for decisions.

8. Subscriptions, purchases, and billing

If you purchase a subscription or in-app purchase, billing is handled by Apple App Store and/or Google Play (as applicable). We do not process or store your payment card information.

Subscription terms (price, renewal, trial, cancellation) are shown at the point of purchase and may be managed in your App Store / Play Store settings.

9. Refunds

Refunds for purchases made through Apple or Google are handled by Apple or Google under their respective policies. Please refer to your App Store / Play Store purchase history and support pages.

10. Intellectual property

The Service and all related content, software, design, and trademarks are owned by FYN or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service unless expressly permitted by us.

11. Third-party services and links

The Service may integrate or link to third-party services (e.g., app stores, subscription management, wearable providers). We are not responsible for third-party services and their terms or privacy practices.

12. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you violated these Terms or if necessary to protect the Service, users, or third parties.

You may stop using the Service at any time. Subscription cancellations must be done via your App Store / Play Store settings.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected.

14. Limitation of liability

IN NO EVENT SHALL FYN LABS LLC, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

15. Indemnification

You agree to defend, indemnify, and hold harmless FYN from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.

16. Governing law

These Terms shall be governed and construed in accordance with the laws of New Mexico, United States, without regard to its conflict of law provisions.

17. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of the Service after the effective date means you accept the updated Terms.
